PromptStamp.com Terms And Conditions

Welcome to PromptStamp! By visiting or using our marketplace (the “Service”), you agree that you will be legally bound by these Terms and Conditions (“Terms”). Better to read them carefully.
1. The PromptStamp Service
PromptStamp operates an online marketplace where Sellers can list and sell custom prompts that can be executed with generative Artificial Intelligence models (e.g., Midjourney, DALL-E, ChatGPT) to Buyers. PromptStamp acts as just a marketplace for these exchanges.
2. General User Requirements
2.1 Eligibility
You are at least 18 years old in order to use the Service. You confirm and warrant that you have the requisite rights, authority, and capacity to agree to these Terms by using PromptStamp.
2.2 Prohibited Content
You agree not to make a list, buy, or use any prompts that:
Violate any applicable legal statute or regulation.
Are hateful, defamatory, or discriminatory.
Infringe the intellectual property rights of any third party (copyright or trademark).
Publish or post illicit, obscene, or malicious material.
3. Buyer Terms (Purchasing Prompts)
3.1 Prompt Usage License
When you buy a prompt, the Seller gives you a non-exclusive, global, and permanent licence to use the produced AI content for personal, business, and commercial use. You will not resell, redistribute, or transfer the prompt file to a third party.
3.2 NO REFUNDS POLICY
Since digital goods will be transferred immediately upon purchase and cannot be “returned,” orders placed on PromptStamp.com for any type of prompt will be treated as final.
No refunds will be given after the prompt file has been downloaded or rendered usable by the client.
Buyer Responsibility: It is strongly advisable that Buyers review the prompt examples, description, and message the Seller asks before they make a purchase.
Quality Assurance:
While PromptStamp will be able to scan quality for prompts, it will not be ensured that the standalone AI model will produce the same outcome for every consumer since it operates off our site.
3.3 Messaging Sellers
Buyers can message Sellers on our platform with pre-sale questions. You agree to use this feature respectfully and only with genuine questions related to the prompt.
4. Seller Terms (Selling Prompts)
4.1 Submissions
In offering a prompt for sale, you confirm that:
You are the only creator of the prompt.
It doesn’t violate the rights of other parties.
Additionally, the prompt runs correctly, as shown in your example images/outputs.
4.2 PromptStamp Commission
For running the marketplace, PromptStamp will maintain a 20% commission on the aggregate sale amount of every sold prompt. Thus, the Seller will retain 80% (not counting our payment processor’s transaction fees).
Payments will be made in accordance with the terms provided by Payeer, our own independent payment processor.
4.3 Seller Removal
PromptStamp may remove any prompt or freeze a Seller’s account without notice if we determine that the content breaches these Terms, our Submission Guidelines, or undermines the integrity of the marketplace.
5. Intellectual Property Rights
PromptStamp retains total intellectual property rights in the platform itself, website design, logos, and software.
Intellectual property for every prompt file belongs originally to the respective Seller.
Listing a prompt on PromptStamp entitles us to a global, non-exclusive, royalty-free license to use the title, description, and examples on the output for advertising, as well as promotional usage.
6. Restrictions on Liability
PromptStamp and its affiliates will not be liable for any indirect, incidental, special, punitive, or consequential damages, or any loss of revenues or profits, directly or indirectly incurred, arising from (a) your access or use of the Service; (b) any prompt purchased from the platform; or (c) any unauthorized access by anyone to your account.
